Police caution
|
Dear fellow Whoers,
How do I find out if my daughter has a police caution for possessing cannabis?
We're looking to book a holiday to Florida and she admitted she was spoken to by police before Xmas and thought he had given her a caution.
Nothing has been received in the post.
Is there somewhere online she can look?
Thanks 10th
P.S. No links!

Spot on.
They DO NOT have access to check for this so unless you declare it on your waiver they won't know.
Say nothing and off you go.

Do the online esta and don't declare it. Believe me it ain't worth it, I've just been through the whole painful process and got fucked off. If I had just a caution there is no way I would have bothered. Sounds like she just had a talking to anyway.

Yes I am the Virgin Mary.
I have never been in trouble with the police, a rare thing it would seem on here.

The Americans do not have access to PNC, so there is no way they'd know about it unless she declares it.
In other words, they can't check. So unless you tell them, they'll never know. Don't worry about it.

I've had four. Went to the states three yrs ago ..no problems. Cautions are for minor offences..and as Animal stated won't affect your life unless you need advanced disclosure..even then.. depending on the offence not necessarily game over.

If your daughter was cautioned formally, as opposed to being just ticked off or warned, she would have been given a copy of the paperwork explaining about it. As someone else said, she would have had to give prints and a DNA mouth swab.

Some of the information here is wrong. Cautions do form part of a criminal record. They are wiped after a certain time but are still available for enhanced disclosure, for instance if you plan to work with vulnerable people.

I'm probably in the minority here but if my son was cautioned for possessing cannabis the last thing I would be doing is rewarding him with a holiday in the States.

Fuck all to worry about just do the ESTA and go.
Mate got nicked in NY few years back for graffiti, had a fight with couple of blokes, Police turned up gave him a shoeing, kept in in for the weekend...went back next year no probs.
I've been nicked 5 times, 4 in this country, once abroad and I'm off to the U.S on Thurs!
Been to NY pretty much every year sor last 10 years.

I've had police cautions and fines for vandalism, pissing in public, drinking in public and trying to knock-out some Chelsea wanker when I was steaming drunk. All pretty petty stuff, I know. All before I was 20 though.
Didn't stop me going to America and getting jobs with full police checks etc.

If she's over 18 probably just a cannabis warning, not worth the paper it's printed on and not disclosable
Same for a pnd
A caution would've meant she's been nicked in first place and if under 18, you would've known about it anyway

Cautions do form part of a criminal record. And as gavros said, are usually administrated at a police station, and she would definitely know she was getting one.
If she was just spoken to on the street, she hasn't got one. Most likely a cannabis warning which is a local thing and doesn't constitute a criminal record.

cautions do show up on advanced checks, which the americans have access to. very much doubt theres any reciprocity there. but as said before, unless she went though all as i described she doesnt have a caution.

If she has had a caution then it won't be on any records. If she was issued a Public Notice Disorder then it's a £90 fine which would be on the police system. But you wouldn't be able to call up and ask if she was given one
